Terms and Conditions

The owner and all rights is reserved for Juvy’s Gold Jewellery Shop Ltd. and is subject to all Canadian laws including tax reporting and other regulatory standards in Canada.

This website (thegolddigger.ca), including all content made available through the website, (“Site”) is owned and operated by Juvy’s Gold Jewellery Shop Ltd. and the trade names (“The Golddigger” & “Madam Golddigger”), collectively, (“Golddiggers”). 

Anyone or other legal entity accessing services and products (“Products”) provided at this website or purchasing products from The Golddiggers are referred to as (Miners), and are subject to the following notices, terms, and conditions.

These Terms and Conditions and the Privacy Policy form a legally binding agreement between the Gold Miners using our site and Gold diggers representing Juvy’s Gold Jewellery Shop Ltd. in relation to your use of the Golddigger’s Services.

 

The Golddiggers currently accepts Visa, MasterCard, American Express, Discover, etransfer and by request Paypal, direct bank transfers and others.

• All transactions are in Canadian Currency (CAD).

• Full payment due immediately.

• Reserve and pay later – 30% down payment due immediately plus a 5% monthly fee. Full payment due before shipping the items.

*No products are shipped until full payment is received.

 

Fully payment is due immediately on all orders and orders expire within 12 hours of your notification. You can reserved your order for a 5% monthly fee and 30% downpayment by request only.  A reminder may be sent a few hours after you are notified before the order is cancelled.

If do not want to loose your items, please pay promptly or arrange for a downpayment.

 

You must include correct information (e.g., the address and phone number the payment credit card issuer has on file for you) when using our site. Incorrect information may cause delays in establishing service. All information received from you, including credit card and/or bank account information, will be treated in accordance with The Golddiggers’s Privacy Policy. Please note that The Golddiggers may receive updated information regarding your payment card account, debit card account or bank account from your financial institution and by accepting these Terms you hereby consent to such updating. For example, The Golddiggers may receive updated card expiration date or account number information. During account registration, The Golddiggers may verify that your payment card is valid.

 

If you elect to pay The Golddiggers via a debit card, you hereby waive your rights under 12 C.F.R. 205.10(d) to receive ten days’ advance notice of the amount and date of all varying electronic fund transfers, so long as the transfer falls inside the range of $0.01 and the sum of any amounts you authorize for insurance, hidden postage labels, reset fees or other non-recurring charges.

 

Our pricing starts at the best price and you choose your fees. Pay by credit card adds a 3% fee yet etransfer is free. You will never be charged any hidden fees.  The Golddiggers’s service fee and any other applicable fees due, including fees for postage or shipping (if applicable), will be provided to you by the invoice or cart check out before you agree to pay. 

Canadian taxes are collected and submitted to the CRA by The Golddiggers.  International Miners may be assessed by customs or couriers to pay your local taxes, duties or import fees.  These chargers are the Miner’s responsibility, any packages that are returned for failure to pay duties and taxes will not be refunded.

 

No refunds shall be applicable for a Canada Post shipment that has been provided to any carrier. In addition, no rate credits shall be applied in the event your shipment could have qualified for a less expensive rate.

Refunds for product defects, errors by the Golddiggers and shipping insurance claims for products damaged during shipping are available. 

Full refunds for special circumstances are also available.  Examples are such as family emergencies or unexpected hardships.  If you make a full purchase, down payment or enter into a payment plan and find yourself or family suddenly going through a crisis and no longer are in a position to make this purchase, please reach out to us and we will refund the full amounts.  We are a family owned business too.

 

A parcel is considered undeliverable if (i) the recipient’s address is incomplete, illegible, incorrect or cannot be located, (ii) delivery cannot be made because of the unavailability or refusal of an appropriate person to accept delivery or sign for delivery of the shipment on the initial delivery attempt or reattempts, (iii) the parcel is unable to clear customs, (iv) the recipient refused to pay for duties and taxes as required by that method of delivery. If the parcel is undeliverable for any reason, we may attempt to notify you and to arrange for the return of the parcel, subject to any local regulatory restrictions. Additionally, we may, in our sole discretion, return the parcel to you or dispose of the parcel. You will be liable for any and all costs, charges and fees incurred in returning or disposing of an undeliverable parcel.

 

In the event your parcel is lost and/or damaged prior to delivery, the Golddiggers offers a limited shipping insurance pursuant to Canada Post’s claim acceptance.  If you have purchased the shipping insurance you will be eligible for a refund.

Parcel Coverage will be limited to the sum of the value of shipping insurance purchased, not the value of the item.

Coverage is not applicable to undeliverable and rejected parcels.

 

You agree that we, our shipping partners, or any governmental authority including customs and security may open and inspect your shipment at any time.

 

Notwithstanding anything in the The Golddiggers Privacy Policy to the contrary, you consent to the disclosure of certain personally identifiable information, as well as shipping item information, by The Golddiggers and its partners to any third party shipping partner utilized as part of the Canada Post service, and, in addition to other third parties (such as customs and revenue authorities, as well as other government agencies), in connection with the processing, export and customs clearance, and international transportation of any shipment. The Golddiggers cannot control the privacy policies of its third party partners their service The Golddiggers and you hereby waive any claim related to the disclosure of personally identifiable or shipment information as part of Canada Post.

 

You acknowledge that (i) content on the Site and content available through the Services is protected by copyrights, trademarks and other intellectual and proprietary rights (“Rights”); (ii) these Rights are valid and protected in all media and technologies existing now or later developed; and (iii) except as explicitly provided otherwise, the Terms and applicable copyright, trademark and other laws govern your use of such content. Any other use, including but not limited to the reproduction, modification, distribution, transmission, republication, display, or performance, of the content on this Site is strictly prohibited.

Miners agree, with the limited exceptions above, to resolve all disputes between you and the The Golddiggers through BINDING ARBITRATION. ARBITRATION MEANS THAT YOU AND THE THE GOLDDIGGERS ARE EACH WAIVING THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.
